Iowa Guardianship and Conservatorship Handbook

 The Young Lawyers Division of the Iowa State Bar Association has put out a handbook for Guardians and Conservators in Iowa.  It is a helpful and easy to follow guide for administering a conservatorship or guardianship.  You can download the handbook here.

?? When the ward dies - all his property was sold to pay his nursing home fees - there is little cash left - does this have to go to an estate - does it have to go to probate? People are asking these questions when we ask about refunds on health premiums etc.

??Our son is now an adult and he is mentally challenged. We have been advised to file for guardianship over him. Would we as his guardians, be personnally financially responsible for any damages he causes?

Kim-

You do not become financially responsible for his actions by simply being his guardian. But, you can be responsible if something happens to him while you are responsible for his care if you don't act prudently.
